Bollywood superstar Salman Khan Wednesday sought the quashing of charges of culpable homicide not amounting to murder against him in a 2002 hit-and-run case.

The sessions court, however, deferred the arguments in the case to March 8, since a magistrate had referred the case for trial.

Sessions Judge A.N. Patil told Salman Khan's lawyer Ashok Mundargi that the appeal for quashing the charges should be filed in the Bombay High Court.

A magistrate court had invoked the charge of culpable homicide not amounting to murder and shifted the trial to the sessions court last month. The charge, if proved, can attract a maximum punishment of 10 years in jail.

He was tried earlier by a magistrate under a lesser charge of causing death by negligence that provided a maximum punishment of two years in prison.

Khan had rammed into a bakery in suburban Bandra killing one person and injuring four others who were sleeping on a pavement Sep 28, 2002.
